1. Acceptance of Terms
By accessing or using the Mobiskul platform, website, and related services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.
2. Eligibility
The Services are intended for schools, educational institutions, and their authorized communities. You must be at least 18 years old (or the age of digital consent in your jurisdiction) to register an account, and schools are responsible for authorizing users and obtaining parental consent for students where required.
3. Account Registration and Responsibilities
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. Multi-factor authentication should be enabled where available.
4. Service Description and Scope
Mobiskul provides cloud-based software for admissions, attendance, academics, fees, communication, and related school administration. Features may evolve, and we may add, modify, or discontinue features with notice where material.
5. Acceptable Use
You agree to use the Services lawfully and in accordance with our Acceptable Use Policy. You will not misuse the Services, attempt to gain unauthorized access, or interfere with their integrity or performance.
6. Payment and Billing
Paid plans are billed in advance on a recurring basis according to the selected plan. Fees are exclusive of taxes unless stated. Failed payments may result in suspension. Pricing and plan details are presented at the point of purchase.
7. Subscription, Trial, and Cancellation
Free trials are provided for evaluation and may be limited in time or features. You may cancel a paid subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds except as required by law or stated in an order form.
8. Intellectual Property
The Services, including software, designs, and content, are owned by Mobiskul or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services during your subscription. "Mobiskul" and related marks are our trademarks.
9. User-Generated Content
You retain ownership of data you submit. By using the Services, you grant us a limited license to process that data solely to provide and improve the Services. You are responsible for ensuring you have the rights to submit such data.
10. Limitation of Liability
To the maximum extent permitted by law, Mobiskul is not liable for indirect, incidental, or consequential damages. Our aggregate liability arising from the Services shall not exceed the amounts paid by you in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold Mobiskul harmless from claims arising out of your use of the Services, your data, or your violation of these Terms.
12. Termination
We may suspend or terminate your access for material breach, non-payment, or legal/security reasons, with notice where practicable. Upon termination, your right to use the Services ceases and data handling follows our Privacy Policy.
13. Dispute Resolution
We encourage resolving disputes informally first by contacting support. Where unresolved, disputes may be subject to mediation or binding arbitration as specified in an applicable order or jurisdiction.
14. Governing Law
These Terms are governed by the laws of India, without prejudice to mandatory consumer protections in your country of residence. The courts of competent jurisdiction in India shall have exclusive jurisdiction, subject to applicable local law.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via the Services or email, and continued use after changes take effect constitutes acceptance.
